My teacher accused three classes of cheating?

My history teacher accused three (periods 3, 8/9, and 10) classes of cheating on an open note test.

The location of this school is Pennsylvania.

The class is 9th grade.

Info:

The classes had to read a packet on a Shoemaker and a Funeral, incase it makes a difference. We had been informed the day before (December 8, 2009) that there was going to be a pop-quiz the next day (December 9, 2009) and we should properly prepair ourselves for it. (There was a side note said by the teacher, ';Make sure you know the definition of some words such as Deference, and the test will be open notebook. However, you will only have five minutes to take it.';) That statement was only heard from very few and made note of it. The day of the test (December 9, 2009) the teacher passed out the papers and we used the five minutes properly, however he gave us all an extra 5 minutes. In between times of test taking the teacher made a speech about cheating. The same teacher today (Debember 10, 2009) had said about his period 8/9 class cheating (9 people admited to cheating.) However he said no one from his period 3 class admited to it and said he thinks that they are all cheaters and liers, but will let their grades stay the same unless proven otherwise. My class is period 10, he had asked if anybody knew of any cheating going on and everyone said no. He later made a speech about cheating and how you would get a 0/5 if you said you cheated. That same class had 4 people who cheated in it. My question is, if it is open notebook and the teacher tells you to prepair any way that you need to in order to take the test, is it still considered cheating? He is talking about taking writes away for something he cannot prove. There is a big gap for thinking information that was in the packet (he underlined at least two of the five answers himself before distributing the packet) was a good idea to underline / highlight and cheating with a friend. I just would like to be able to stand up to the teacher because he is very strick and says he has no trust for any of his students anymore due to some of them cheating. He is taking away writes to students that he doesnt know cheated or not, I would like to know something that i can do to get the writes back and get this teacher punished properly.

I would also like to add side notes that this teacher is mainly a German teacher, and was told to do American History about 15 years ago, and does not like his history classes very much. He is a very segragated teacher, not by race, but if you take German he treats you with more respect. He also has very interesting thoughts that he expresses such as ';I could stab my pen through your eye and knock out what ever part of a brain is in your head.'; or ';Good thing im thinking in your head right now because there AIN';T nothing in there'; (those two phrases were said by the teacher.) He doesn't like black people, and not many white people, and I would like justice to win in this case of faulty loss of writes and points.

Teacher has degrees in both American History Education, and German Education.

Thank you.My teacher accused three classes of cheating?
I am not clear as to how you can ';cheat'; on an open book test. Did you all write the same answers?

It sounds as if the teachers directives in all classes lacked precision and clarity and not all students understood what he wanted. In that case, that is the teachers problem, not the students.

Unless this guy can flat out prove that you or your classmates cheated, he is shooting darts in the dark! He cannot penalize you academically or otherwise, or restrict your rights for something he THINKS but cannot PROVE. If he attempts to do so, his actions can get him in a lot of trouble. Whether you know it or not, he has rules and ethics to go by as well.

I might even consider enlisting the help of your parents in talking with this gentleman, who sounds a little biased against American students. Why exactly is he teaching? Is this guy related to Hitler? or Heinrich Himmler? I wonder.......

Enlist the help of a strong parental advocate who can talk with him and if they are unsatisfied or unsuccessful in dealing directly with him, can take their concerns up the hierarchical chain of command and perhaps involve the superintendent of schools and the Board of Education.

No teacher would address or threaten a child of mine by stating ';I could stab a pen through your eye and knock out whatever part of a brain is in your head';. Those types of comments are belittling and derogatory. That certainly is not positive reinforcement. Students need positive reinforcement, as do all people, as most people will bust their tail to do even better if you tell them what they are doing right, rather than what they are doing wrong all the time.

The emotional welfare of students is also as important as maintaining their physical safety.

This guy needs a kick in the pants! Chances are there have been complaints lodged about this one before, as this type of behavior is usually typical of a pattern.

Good Luck!My teacher accused three classes of cheating?
some day you will wake up and find out not everything goes your way...
